No. BDA is not a law firm and cannot represent you in court. We coordinate with attorneys through our partner network at Delancey Street. The attorneys handle court appearances, filings, and any motion practice. BDA’s role is to negotiate with the MCA holder for a settlement that resolves the underlying debt.
What is a confession of judgment (COJ)?
A confession of judgment is a clause some MCA agreements include that allows the lender to obtain a judgment against the borrower without a court hearing if certain conditions are met. New York restricted COJ enforcement against out-of-state debtors in 2019, but COJs filed before that change or in other jurisdictions remain enforceable. Vacating a COJ requires fast attorney action - consult counsel immediately.
How long do I have to respond to an MCA lawsuit?
Response deadlines vary by jurisdiction but are typically 20 to 30 days from the date of service. Missing the deadline can result in a default judgment, which gives the lender additional collection tools (bank levies, account freezes, asset seizures).
