Why daily payments squeeze auto businesses

Auto business debt relief starts with a timing problem: many auto businesses earn money in lumps and spend it in a steady stream. A merchant cash advance with a fixed daily ACH debit pulls the same amount either way. According to the Federal Reserve Banks' 2025 Small Business Credit Survey, 50% of small employer firms across industries reported uneven cash flow as a financial challenge in the prior 12 months, and 73% reported higher costs for goods, services or wages.

Repair, tire and lube shops: parts costs and slow seasons

Parts are often paid for up front or on short supplier terms, and they cost more than they used to. According to the Bureau of Labor Statistics, the consumer price index for motor vehicle parts and equipment rose about 29% from September 2019 to September 2026. Demand can follow the calendar too: in many markets, tire changeovers and winter battery work are followed by quiet stretches. A debit sized off a busy month pulls just as hard in a slow one. See our page on debt relief for auto service shops.

Body and collision shops: waiting on the insurer

Collision work is often paid by the insurance carrier, and payment can lag well behind the repair while estimates and supplements are reviewed. Direct repair program (DRP) work can bring volume, along with carrier requirements that vary by program. Some owners take an advance to bridge that gap, then a second when the first one's debits outlast the claim. Our page on debt relief for auto body shops covers that pattern.

Used-car lots: floor plan lines plus advances

Many used-car dealers carry inventory on a floor plan line repaid as each vehicle sells. According to the OCC Comptroller's Handbook on floor plan lending, these agreements normally include curtailments, required principal paydowns on units that have not sold within a set time. When aged units pile up, curtailments and a daily debit can hit the same account in the same week.

Towing, detailing and parts stores: equipment and card receipts

Many tow operators and detailers carry truck and equipment loans or leases with fixed monthly payments, and parts stores often carry inventory and trade accounts. Card deposits can land in uneven batches, so a daily debit can empty the account before the equipment payment clears.

Auto business debt help: what your options are

When advance payments or other business debt outgrow what the shop or lot brings in, auto business debt relief comes down to a handful of real paths.

Restructuring

Restructuring is direct negotiation with each lender, separately, to replace the original contract with a new one at a payment the business can sustain. If a funder agrees, the balance stays roughly the same and the schedule changes: a smaller debit, a longer window, or a single monthly payment you can plan around insurance checks, curtailments or your slow season. Settlement

Settlement asks each funder or creditor to accept less than the contracted balance and close the account. Whether a creditor agrees, and on what terms, depends on the contract, the funder and how far behind the account already is, so results vary.

Consolidation

Consolidation pays off existing debts with one new loan. With advances there is a catch: a broker's "consolidation advance" is often just another MCA, sometimes at higher cost, and UCC filings from existing advances can block traditional refinancing.

Doing nothing

When debits stop, funders often escalate, though not always in this order: collection calls, a default notice, UCC lien enforcement, then a lawsuit. Some agreements, especially older ones, also include a confession of judgment. New York changed its law on those filings in 2019: according to the text of New York Senate Bill S6395, signed on August 30, 2019, a confession of judgment can only be filed in the county where the defendant's affidavit says it resided when signed or where the defendant resides at filing, and a business resides where it has a place of business. For affidavits filed from that date on, that generally shut New York courts to these filings against businesses with no place of business in New York, though the law lets government enforcement agencies file in any county. Rules in other states vary.

Business Debt Adjusters is a debt settlement company, not a law firm, and does not provide legal advice. Where a lawsuit is active, BDA coordinates with its attorney network while negotiating the underlying debt.

Auto business debt help: common questions

Can an auto repair shop restructure an MCA around slow seasons?

It may be possible. Restructuring asks each funder to replace a daily or weekly debit with a new schedule, and an owner can use that negotiation to ask for a monthly payment that fits the slowest months. Whether a funder agrees depends on the contract and how far behind the account is.

My body shop waits on insurance payments. Does that matter to a funder?

It can. A shop whose receivables arrive in insurer batches has a cash flow pattern that a fixed daily debit does not match. Deposit records that show the pattern can support a request for a payment schedule that lines up with when money comes in.

Does a floor plan line change anything for a used-car dealer with an MCA?

It adds another lender with its own terms. Floor plan agreements normally require curtailment paydowns on aged inventory, so those obligations sit alongside any advance. One option is asking the funder to restructure the advance so payments are less likely to collide with curtailments.

Will the UCC lien from my advance come off when the debt is resolved?

According to the model text of Article 9 of the Uniform Commercial Code, which each state adopts with its own changes, a filed financing statement generally stays effective for five years unless continued, and once nothing is owed a business debtor can generally demand a termination statement, which the secured party generally must send or file within 20 days of the demand. Different conditions apply to filings on sold receivables, the form many advances are written in, so check the agreement. BDA uses zero balance letters from settled accounts to request removal of filings.
